Recita Terms of Use

1. Purpose

These Terms of Use govern access to and use of the Recita service, accessible in particular at recita.app.

Recita is an online service that allows, in particular, the import of texts, their structuring for rehearsal, and, depending on the activated features, the generation of associated audio content.

3. Acceptance

Any account creation or use of the service implies full acceptance of these Terms of Use.

4. Access to the service

The service is available to both individuals and professionals.
Creating an account requires a valid email address and a password.

The user is responsible for keeping their credentials confidential and for any use made of the service through their account.

5. Geographic scope and language

The service may be accessible from multiple countries. Certain features, pricing conditions, consumer rights, tax arrangements, or regulatory obligations may vary depending on the user’s country of residence.

These Terms of Use are available in French and English. In the event of any difference in interpretation, the French version shall prevail.

6. Free and paid features

Some features of the service are free of charge, including:

  • script import;
  • use of the service without audio generation.

Some features are paid, including:

  • audio generation or regeneration;
  • associated audio storage.

Recita uses an internal unit called credits. The applicable pricing terms are those displayed on the service at the time of the relevant order or purchase. In the event of any discrepancy between these Terms of Use and the pricing information displayed on the service at the time of the order, the latter shall prevail for the relevant transaction.

As of the date of writing:

  • audio generation: EUR 0.00006000 per character;
  • audio storage: EUR 0.00001944 per GB/hour.

Prices may be changed for the future only, without retroactive effect on transactions already validated.

Displayed prices may be shown exclusive or inclusive of taxes depending on the country, the customer’s status, and the applicable tax obligations. VAT or any equivalent tax is determined at the time of the order.

7. Payment, credits, and refunds

Payments are made via PayPal. Recita does not collect the user’s bank details.

Purchased credits are credited to the user’s account after validation of the transaction according to the rules applicable to the service and according to the information displayed at the time of purchase.

Except where otherwise required by law or by an exceptional decision of the publisher, amounts paid and purchased credits are non-refundable.

In the event of a payment incident, cancellation, refund, chargeback, suspected fraud, or reversal, the publisher may suspend the account, freeze paid uses, or cancel the affected credits.

8. Right of withdrawal

Where a user qualifies as a consumer, they in principle benefit from the right of withdrawal applicable to distance contracts, unless a legal exception applies.

For certain paid features executed immediately, in particular where the user requests the activation or use without delay of a digital service or credits that may be used immediately, Recita may collect, at the time of the relevant purchase, the consumer’s express request for immediate performance together with their acknowledgment that they will lose their right of withdrawal in the cases provided by law.

This request and acknowledgment apply only to the relevant transaction and not generally to all future purchases.

The provisions of this article apply to users who benefit from a right of withdrawal under the law applicable to them. Where a user qualifies as a consumer and resides in another Member State of the European Union, they also benefit from the mandatory protective provisions applicable in their country of habitual residence.

9. Rules of use

The user agrees not to:

  • use the service for unlawful purposes;
  • impair the proper functioning or security of the service;
  • engage in scraping, mass extraction, reverse engineering, or any technical circumvention;
  • use the service or its outputs to train a competing model or service;
  • import content without having the necessary authorization for their personal or otherwise legitimate use.

The user remains solely responsible for the content they import, process, store, or generate through the service.

10. Suspension, termination, deletion

The publisher may suspend or restrict access to the service in the event of abuse, fraud, non-payment, security breaches, manifestly unlawful content, or violation of these Terms of Use.

The user may delete their account at any time through the interface. In the event of voluntary account deletion, any remaining credits are lost.

Inactive accounts may be deleted after 3 years of inactivity.

11. Liability

The service is provided with reasonable efforts as to availability, security, and proper functioning, without any guarantee of uninterrupted service, absence of errors, or absence of malfunction.

To the extent permitted by law, the publisher shall not be liable for indirect damage, loss of business, loss of data, loss of opportunity, or commercial harm resulting from use of the service, its unavailability, or use not compliant with these Terms of Use.

The user remains solely responsible for the content they import, process, store, generate, or otherwise use through the service, as well as for compliance with third-party rights.

12. Consumer mediation

In the event of a dispute, the consumer is invited first to send their complaint to the publisher at the following address: support@recita.app.

If the complaint does not lead to an amicable solution, the consumer may, once a consumer mediator has been designated by the publisher, use the competent mediation scheme free of charge.

As of the last update date of these Terms of Use, the publisher is in the process of subscribing to a consumer mediation scheme. The contact details of the competent mediator will be added once this subscription has been finalized, before the effective opening of the service to consumers.

13. Governing law

These Terms of Use are governed by French law.

Where a user qualifies as a consumer and resides in a country whose mandatory protective provisions apply to them, those provisions shall remain applicable under the conditions provided by private international law.
